Important service notice. Offer availability depends on eligibility, an active approved partner campaign, inventory, expiration, location, and displayed merchant terms. An offer or Wallet entry is not a promise of cash payment, medical result, or availability in every location. Consumer Terms of Use

Your agreement with FitCents

1. Scope and acceptance

These Terms govern your access to FitCents websites, mobile applications, member experience, Wallet, and any feature that links to them. FitCents LLC is an Illinois limited liability company; its legal-notice address is 216 Summit Ave, Collinsville, IL 62234, and its legal email is legal@getfitcents.com. By creating an account or affirmatively accepting a current version in the app, you agree to these Terms. The Privacy Policy and Reward & Offer Terms are incorporated by reference. Public website browsing alone does not authorize a payment or participation in a partner campaign.

2. Eligibility and account security

You must be at least 18 years old and use FitCents only where the service is made available to you. FitCents is initially available in the St. Louis and Metro East region. Use accurate account information and protect your credentials. Do not create duplicate, false, or shared accounts; misrepresent eligibility; or use automated tools to access the service. The service is not directed to children under 13. Do not submit a child’s information to FitCents.

3. Service operation and no professional advice

FitCents may update, pause, or remove features, eligibility rules, offers, notifications, and regions for security, reliability, legal compliance, or member experience. FitCents is not a health-care provider and does not provide medical, nutrition, fitness, insurance, investment, or financial advice. Consult a qualified professional for decisions about health or diet.

4. Permitted use and acceptable use

Use the service for your personal, lawful participation in disclosed offers. Do not scrape, reverse engineer, bypass security, use bots, copy or resell offer codes, interfere with checkout, submit false redemption or relationship information, post unlawful content, infringe rights, or use FitCents to compete against or harm the service, members, or partners.

5. Wallet, Passes, codes, and partner checkout

A Wallet item, pass, barcode, code, link, or checkout route is a limited, revocable access credential—not money, stored value, a bank account, insurance, a financial product, or a transferable asset. Keep it private. FitCents may open a partner checkout path or copy a partner-supplied code, but the merchant controls its final cart, payment, fulfillment, returns, and product terms.

6. Intellectual property and third-party services

FitCents and its marks, software, and content are owned by or licensed to FitCents LLC. We grant you a limited personal, revocable right to use the service under these Terms. Partner names, products, and checkout experiences belong to their owners. Their separate terms and privacy notices govern their services.

7. Suspension, termination, and changes

You may stop using FitCents at any time. We may suspend or terminate access to protect people, investigate abuse, address security or legal risk, or enforce these Terms. We may update these Terms for a material product, legal, or operational change and will request renewed acceptance when appropriate. Continued use after a required reacceptance is not permitted until the new version is accepted.

8. Disclaimers and liability

Except where law does not allow it, FitCents is provided “as is” and “as available.” We do not guarantee continuous operation, a particular offer, savings amount, workout outcome, partner inventory, merchant acceptance, or a result from any fitness activity. To the maximum extent allowed by law, FitCents is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages. Nothing here limits rights that cannot be waived under applicable law.

9. Disputes, electronic records, and contact

Except for a qualifying small-claims-court matter, you and FitCents agree to resolve an individual dispute arising from these Terms or the consumer service through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You may opt out of this arbitration agreement within 30 days after first accepting these Terms by sending your name, account email, and a clear opt-out statement to legal@getfitcents.com or the legal-notice address above. You and FitCents waive class, collective, representative, and jury-trial proceedings to the extent permitted by law; this does not waive any right that cannot lawfully be waived. Illinois law governs except where nonwaivable consumer law applies. You agree that FitCents may provide service notices electronically through the app, website, or account email. Privacy Policy

How FitCents handles information

1. Information we collect

Depending on how you use FitCents, we collect account and authentication information; optional profile details such as first name, ZIP code, and reward interests; app, device, browser, and security information; support and request communications; and offer, Wallet, checkout, redemption, referral, and product-event records. We collect Apple Health information only after you use the separate Apple Health permission flow described below.

2. Why we use it

We use information to operate and secure accounts, provide features, verify eligibility, make offers available, measure configured outcomes, prevent fraud and abuse, answer requests, maintain records, diagnose failures, improve usability, comply with law, and protect FitCents, members, and partners. We do not use raw HealthKit or workout information to create advertising audiences.

3. When information is disclosed

We disclose information to service providers that help us operate authentication, hosting, databases, security, communications, and payment or campaign infrastructure; to a merchant only as needed for a disclosed checkout, fulfillment, or verified campaign outcome; when you direct us to disclose it; and when required to protect rights, safety, security, or comply with law. Partners may receive approved campaign attribution and aggregate outcomes—not raw HealthKit, workout, medical, or inferred-health data.

4. Sales, targeted ads, and raw health data

FitCents does not sell raw Apple Health or workout information, disclose it to brands for advertising or targeting, use it to build health-derived audiences, or permit re-identification from aggregate campaign reports. A partner’s own checkout, product, and privacy practices apply once you leave FitCents for that merchant’s service.

5. Retention and security

We retain information for as long as reasonably needed for the stated purpose, account operation, security, fraud prevention, disputes, accounting, and legal compliance. When you delete your account, FitCents removes or de-identifies account data as described in the feature flow; it may keep legally required, security, transaction, and dispute records in protected form. We use reasonable safeguards, but no system is guaranteed secure.

6. Your choices

You can decline or revoke device permissions, manage nonessential notification preferences, opt out of optional website analytics through Cookie Preferences, and request access, correction, deletion, or a marketing preference change through Account & Data Requests. We may need to verify a request and may retain information where allowed or required by law.

7. Communications and marketing

FitCents may send transactional account, security, eligibility, Wallet, and service communications. Marketing email, marketing text messages, and promotional push notifications require their own applicable consent and preference controls. Acceptance of these Terms is not marketing consent and does not establish an SMS program.

8. Privacy questions and updates

For a privacy question or request, use the request form or email legal@getfitcents.com. If we materially change this policy, we will publish an updated version and request new consent when required. This policy should be read with the Health & Fitness Data Notice below.

What FitCents requests

If you select “Continue to Apple Health Permissions,” FitCents requests read-only access to workout type, duration, start time, active energy when available, and the source and end time needed to determine eligibility. The current feature checks qualifying workouts from the prior seven days. Apple’s system permission controls whether access is granted.

How FitCents uses it

FitCents uses this information only to operate the fitness-and-reward eligibility feature, including confirming an eligible activity day and making eligible offers available. We do not write workouts to Apple Health. Basic account access remains available if you choose “Not Now,” but rewards that require verified activity may not be available.

What FitCents does not do

We do not use HealthKit, Motion & Fitness, workout, medical, or inferred-health information for advertising, marketing, data mining, audience creation, resale, or brand profile enrichment. We do not disclose raw HealthKit data to partners. Partners receive only approved aggregate campaign outcomes and may not re-identify members from them.

Your control

You can decline, revoke, or change Apple Health access in device settings. A denial may appear to FitCents as no available data, which helps preserve the privacy of Apple Health permissions. You can also delete your FitCents account through Settings or the data-request form. Apple Health data remains controlled in Apple Health.

Reward & Offer Terms

Rules for earned offers and Wallet use

Eligibility and display

An offer may be limited by account standing, availability group, geography, eligibility rules, inventory, expiration, partner terms, and other disclosed conditions. A reward unlock, Wallet add, or code display is not a guarantee that a merchant will accept or fulfill an offer.

No cash value or transfer

Offers have no cash value unless an offer specifically and lawfully says otherwise. They may not be sold, transferred, copied, posted, redeemed through another person’s account, or combined with another promotion unless the offer terms allow it. FitCents is not a cash-back or receipt-rewards program.

Offer-specific terms control

Before you add or use an offer, review its merchant, product, value, code, redemption method, expiration, exclusions, geographic limits, purchase requirements, and any customer-status declaration. If an offer-specific term conflicts with this page, the specific term controls for that offer.

Merchant checkout, returns, and chargebacks

Your transaction is with the merchant. The merchant controls payment processing, shipping, returns, refunds, taxes, support, and final acceptance. Ask the merchant about an order problem first. FitCents may investigate a verified offer or measurement error, but it does not process a consumer chargeback for a merchant sale it did not charge.

New-to-brand declaration and measurement

For a configured campaign, FitCents may ask whether you are new to a brand or a returning customer when you first add an offer. Answer truthfully. This declaration supports campaign attribution and may be recorded for that offer. It is not health information and does not mean FitCents has independently matched you to a merchant’s customer file unless the offer explicitly says so.

Fraud, corrections, and changes

FitCents may void, pause, correct, or remove an offer or account for error, expiry, code failure, inventory failure, suspected fraud, duplicate accounts, unauthorized sharing, inaccurate attribution, legal risk, or partner noncompliance. Offers and redemption methods can change without creating a right to substitute value except where law requires otherwise.

Version and release notes

Effective September 5, 2026. This package reflects the Build 28 release source: private earned offers, no general cash-back program, Apple Health read-only eligibility, no raw health-data advertising or partner sharing, and versioned consumer/partner terms acceptance. The current launch scope is adults 18 and older in the St. Louis and Metro East region.
